Car Owner Terms — Host Agreement

1. Introduction and Acceptance

These Car Owner Terms (this "Host Agreement") govern listing your vehicle for peer-to-peer rental through OnFire. OnFire provides the marketplace, payments, and tooling that connect you with renters; OnFire does not own, operate, insure, or supply your vehicle and is not the lessor of any rental. You list and rent out your vehicle as an independent Owner.

By listing a vehicle and by accepting bookings, you accept the version of this Host Agreement presented to you. Your acceptance of the current owner terms version is recorded, and you may be required to re-accept when these terms are updated. This Host Agreement is in addition to the OnFire Terms of Service.

2. Roadworthiness & Registration Warranty

You warrant, for every trip, that the vehicle:

  • Is roadworthy, mechanically sound, and safe to drive, with all safety systems functioning.
  • Holds a current, valid registration and any legally required inspection or roadworthiness certificate.
  • Is legally owned by you or listed with the documented permission of the owner, with the right to rent it out.
  • Is free of any recall, defect, or condition that would make renting it unlawful or unsafe.
  • Has valid road tax and meets all local legal requirements for operation on public roads.

You must remove a listing from availability immediately if the vehicle ceases to meet these requirements. Renting out a non-roadworthy or unregistered vehicle is a serious breach and may result in immediate removal and full liability for resulting harm.

3. Listing Accuracy

You must ensure your listing is accurate and current, including the make, model, year, condition, mileage allowance and overage rate, fuel/charging policy, minimum driver age, pricing, deposit amount, location, delivery options, and photographs. Photographs must depict the actual vehicle. Material inaccuracies that harm a renter may entitle the renter to a refund and may result in penalties or removal.

4. Payout Terms

Earnings

Your payout for a completed trip is the trip total collected from the renter, less the OnFire service fee, applicable taxes, and any adjustments. The fee and net payout are shown before you accept.

Timing

Earnings are credited after the trip is completed. Payouts are made to your connected payout account subject to processor timelines and any holds for open disputes or claims.

Deposits

Security deposits are held, not paid out. Any amount captured to settle a valid claim is disbursed separately from your trip earnings, subject to the claims process.

Taxes

You are responsible for reporting and paying any tax due on your rental income. OnFire does not provide tax advice.

5. Cancellation Penalties

When you cancel a confirmed booking, the renter is made whole with a full refund, regardless of the listing's cancellation tier. Owner-initiated cancellations damage renter trust and may carry penalties, including:

  • A reduction in your reliability rating or search placement.
  • Automatic blocking of the cancelled dates to prevent re-listing at a higher price.
  • A cancellation fee where permitted, particularly for late cancellations close to trip start.
  • Suspension or removal for repeated or last-minute cancellations.

Failing to hand over a vehicle for a confirmed trip (an owner no-show) is treated as an owner-fault cancellation: the renter receives a full refund and an incident may be recorded against your account. The renter's cancellation tiers are described in the Car Cancellation Policy.

6. Deposit & Damage Claims Process

If a vehicle is returned with damage, excess mileage, a fuel/charge shortfall, or other chargeable items, you may open a claim against the renter's security deposit. To do so you must:

  • Open the claim within the dispute window that begins when the deposit hold is placed. Late claims cannot be honoured against the hold.
  • Provide evidence, including start- and end-of-trip condition photographs, odometer readings, and repair or replacement estimates.
  • Claim only amounts genuinely and reasonably attributable to the renter's use.

Claims are adjudicated by OnFire on the evidence. Approved amounts are captured from the hold; the remainder is released to the renter. Submitting false, inflated, or unsupported claims is a breach and may result in reversal, penalties, and removal. Timing of holds, dispute deadlines, capture, and release is set out in the Car Deposit Policy.

7. Insurance Responsibility (No Platform Coverage)

OnFire does not provide insurance or any protection product for your vehicle or your rentals.

You are solely responsible for ensuring the vehicle carries all legally required insurance and that your policy permits renting the vehicle to third parties. Many personal motor policies exclude commercial or peer-to-peer rental use; you must confirm your coverage before listing.

The security deposit is a limited financial remedy between you and the renter and is not insurance. It may not cover the full cost of loss, and OnFire is not liable for shortfalls, uninsured loss, theft, or third-party claims arising from your rentals.

8. Owner Conduct & Prohibited Practices

You must not:

  • List a vehicle you are not entitled to rent out, or one that is unsafe, recalled, or unregistered.
  • Misrepresent the vehicle, its condition, its coverage, or the terms of the rental.
  • Demand off-platform payment or attempt to bypass OnFire's booking, payment, or deposit systems.
  • Discriminate against renters unlawfully.
  • Submit fraudulent damage or deposit claims, or retaliate against a renter for a legitimate dispute.

Breach of this Host Agreement may result in withheld payouts, removal of listings, and account termination, in addition to any liability you incur.

By listing a vehicle and accepting bookings, you acknowledge that you have read and agree to this Host Agreement in the version presented to you.
