Terms of Service

1. Introduction and Acceptance

Welcome to OnFire. These Terms of Service ("Terms") govern your access to and use of OnFire's mobile application, website, and related services (collectively, the "Service" or "Platform"). By creating an account, accessing, or using our Service, you agree to be bound by these Terms.

OnFire is operated by OnFire Messenger Inc ("Company," "we," "us," or "our"). If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and the Company. We reserve the right to update these Terms at any time, with notice provided through the app or via email at least 30 days before changes take effect.

2. Eligibility

To use OnFire, you must:

  • Be at least 13 years of age (or the minimum age required in your jurisdiction)
  • Users under 18 must have parental or guardian consent
  • Users in the European Union must be at least 16 years old, or have parental consent
  • Not be a convicted sex offender
  • Not have been previously banned from our Service
  • Provide accurate, current, and complete registration information

For certain features (payments, marketplace, accommodations), you must be at least 18 years old or the age of majority in your jurisdiction.

3. Account Registration and Security

3.1 Account Creation

To access most features, you must create an account by providing a valid phone number or email address, your name (display name), and profile information as requested. You agree to provide accurate information and keep it updated. You may only create one account for personal use.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Not sharing your account or transferring it without our permission

4. Services Provided

OnFire provides an integrated platform combining multiple services:

Social Networking

Profile creation and management, news feed and content discovery, posts, photos, videos, and stories, groups and community features, following and friend connections.

Messaging and Communication

Private messaging, group chats and channels, voice and video calls, end-to-end encrypted conversations (where enabled), media sharing, message reactions and replies.

Location Services

Real-time location sharing with selected contacts, location history and check-ins, safety features and alerts, geofencing notifications.

Marketplace and E-Commerce

Buying and selling products, product listings and discovery, secure payment processing, seller verification and ratings, order tracking.

Accommodations and Rentals

Property listings for short-term rentals, booking and reservation management, host and guest profiles, reviews and ratings.

Wallet and Productivity

Digital wallet functionality, peer-to-peer payments, cryptocurrency support (where available), task management, habit tracking, calendar integration.

5. User Conduct and Prohibited Activities

5.1 General Conduct

You agree to use OnFire responsibly and lawfully. You must not:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Harass, bully, threaten, or intimidate others
  • Post false, misleading, or defamatory content
  • Engage in fraud, scams, or deceptive practices
  • Spam or send unsolicited communications

5.2 Prohibited Content

You must not post, share, or transmit:

  • Illegal content or content promoting illegal activities
  • Child sexual abuse material (CSAM) or exploitation (see Section 15 for our scanning and reporting obligations)
  • Non-consensual intimate imagery
  • Content promoting violence, terrorism, or hate
  • Malware, viruses, or harmful code
  • Content that violates others' privacy

5.3 Platform Integrity

You must not attempt to access accounts or data without authorization, circumvent security measures, use automated tools or bots without permission, reverse engineer our software, interfere with the Service's operation, or create fake accounts.

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of content you create and share on OnFire ("User Content"). By posting content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, display, distribute, and make your content available to others, modify content for technical purposes, and use content for promotional purposes (with your settings). This license continues until you delete your content or account.

6.2 Content Responsibility

You are solely responsible for your User Content and represent that you own or have rights to share the content, it does not violate these Terms or any laws, and it does not infringe on third-party rights.

6.3 Our Intellectual Property

OnFire, including its design, features, code, and branding, is owned by us and protected by intellectual property laws. You may not use our trademarks, logos, or branding without written permission.

6.4 Copyright and DMCA

We respect intellectual property rights. If you believe content infringes your copyright, submit a notice to our designated agent with identification of the copyrighted work, location of the infringing content, your contact information, a statement of good faith belief, a statement of accuracy under penalty of perjury, and your signature.

7. Privacy and Data

Your privacy is important to us. Our Privacy Policy, incorporated into these Terms, explains how we collect, use, and protect your information. By using OnFire, you consent to our data practices as described in the Privacy Policy.

8. Payments and Transactions

Payment Processing

We use third-party payment processors for transactions. By making payments, you agree to their terms and authorize us to charge your selected payment method.

Fees and Pricing

Service fees may apply to certain transactions. All fees are displayed before confirmation. Prices are in the currency specified at checkout. Taxes may apply based on your location.

Refunds and Disputes

Refund policies vary by transaction type. Marketplace disputes are handled through our resolution center. Accommodation cancellation policies are set by hosts. We are not responsible for disputes between users.

Subscriptions

Subscriptions auto-renew unless cancelled. Cancel anytime through account settings. No refunds for partial billing periods. Price changes will be communicated in advance.

9. Third-Party Services and Links

OnFire may integrate with or link to third-party services. We are not responsible for third-party content, products, or services; privacy practices of third parties; availability or accuracy of external links; or transactions with third parties. Your use of third-party services is at your own risk and subject to their terms.

10. Disclaimers and Limitations

10.1 Service Availability

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation, specific features or functionality, data preservation beyond our stated policies, or compatibility with all devices or systems.

10.2 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for indirect, incidental, special, or consequential damages
  • Our total liability is limited to amounts you paid us in the past 12 months, or $100, whichever is greater
  • We are not liable for actions of other users or loss of data, profits, or business opportunities

These limitations do not apply to liability that cannot be excluded by law.

10.4 User Interactions

You are solely responsible for your interactions with other users. We do not verify user identities or conduct background checks (except as required for specific features). Exercise caution when meeting others or sharing personal information.

11. Indemnification

You agree to indemnify and hold harmless OnFire, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your User Content, your violation of these Terms, your violation of any third-party rights, and your transactions with other users.

12. Account Termination

12.1 Termination by You

You may delete your account at any time through account settings. Upon deletion, your profile and content will be removed, some information may be retained as required by law, deletion may take up to 90 days to complete, and certain data may persist in backups temporarily.

12.2 Termination by Us

We may suspend or terminate your account if you violate these Terms or our policies, engage in illegal or harmful activities, create risk or legal exposure for us, or have an account inactive for extended periods. We will provide notice when possible.

12.3 Effect of Termination

Upon termination, your right to use the Service ends immediately, provisions that should survive will remain in effect, and we may retain certain information as required by law.

13. Dispute Resolution

Informal Resolution

Before initiating formal proceedings, you agree to contact us and attempt to resolve disputes informally for at least 30 days.

Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

Arbitration

For users in applicable jurisdictions, disputes will be resolved through binding arbitration rather than court, except for small claims court matters.

Jurisdiction

For matters not subject to arbitration, you consent to exclusive jurisdiction in the courts of England and Wales.

14. General Provisions

Entire Agreement: These Terms, along with our Privacy Policy and other referenced policies, constitute the entire agreement between you and OnFire.
Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
No Waiver: Our failure to enforce any provision does not waive our right to do so later.
Assignment: You may not assign these Terms without our consent. We may assign our rights freely.
Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control.

15. Child Safety Scanning & Content Monitoring

OnFire is committed to protecting minors on our platform. To fulfill our legal obligations under 18 U.S.C. § 2258A and other child protection laws, we employ automated safety systems to detect child sexual abuse material (CSAM) and grooming behavior. By using OnFire, you acknowledge and consent to the operation of these systems.

15.1 On-Device Safety Scanning

OnFire uses on-device artificial intelligence models to analyze text-based conversations for patterns indicative of grooming or exploitation of minors. This scanning occurs locally on your device and does not transmit message contents to our servers unless a safety threshold is exceeded. On supported iOS devices (iOS 17+), Apple's Sensitive Content Analysis framework may additionally scan media for known CSAM material.

15.2 Server-Side Safety Systems

When on-device scanning identifies content that exceeds our safety thresholds, limited metadata and safety event data may be sent to our servers for further analysis. Server-side systems include cloud-based confirmation of flagged content, perceptual hash matching against known CSAM databases, and human review by trained moderators for escalated cases.

15.3 Graduated Enforcement

Based on risk severity, OnFire may take the following graduated enforcement actions:

Low Risk: Safety event logged for monitoring; no immediate user impact
Medium Risk: Content flagged for human review; server-side confirmation initiated
High Risk: Age re-verification may be required; conversation restrictions applied
Critical Risk: Conversation locked; mandatory report filed with NCMEC; account may be suspended pending review

15.4 NCMEC Reporting

As a registered Electronic Service Provider (ESP ID: 6934), OnFire is legally required to report apparent violations involving CSAM to the National Center for Missing & Exploited Children (NCMEC) CyberTipline within 24 hours. Reports include relevant metadata, safety event details, and any content necessary to fulfill our legal obligations. We may not notify the user of such reports as required by law.

15.5 Conversation Restrictions

When our safety systems detect critical-level risks, conversations may be temporarily locked to prevent further harm. Locked conversations remain accessible for reading but new messages cannot be sent. Users affected by conversation restrictions may contact safety@onfire.so for review. Restrictions are subject to human review and may be lifted if determined to be false positives.

15.6 Your Obligations

You agree not to attempt to circumvent, disable, or interfere with safety scanning features. Attempting to bypass safety systems constitutes a violation of these Terms and may result in immediate account termination. You acknowledge that safety scanning is essential to our legal compliance and the protection of minors on our platform.

16. Special Terms for Specific Features

Location Sharing

Location sharing is optional and controlled by you. You can enable/disable sharing at any time. Shared locations are visible only to those you authorize.

Accommodations

Hosts are responsible for compliance with local laws. Guests must follow house rules. We are not responsible for property conditions or host conduct. Cancellation policies are set by hosts.

Cryptocurrency Features

Cryptocurrency values fluctuate; we are not responsible for losses. You are responsible for securing your wallet credentials. Features may not be available in all jurisdictions.

End-to-End Encrypted Messages

E2E encrypted messages are only readable by participants. We cannot recover encrypted messages if you lose access. Certain features may not be available in encrypted chats.

By using OnFire, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
