These Terms are written to be read. If any part of them is unclear, write to [email protected] and we will explain it.

1. Introduction and Acceptance

Welcome to OnFire. These Terms of Service ("Terms") govern your access to and use of OnFire's mobile application, website, and related services (collectively, the "Service" or "Platform"). By creating an account, accessing, or using our Service, you agree to be bound by these Terms.

In these Terms, "we", "us", "our" and "the Company" mean the company that operates OnFire. That company, its registration details and its address are set out in Who We Are and How to Contact Us. If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and the Company. We may update these Terms. We will notify you through the app and by email at least 30 days before a change takes effect, and you may end your agreement with us at any time before that notice period expires. We will not apply changes retroactively, unless a legal or regulatory obligation requires it or the change is to your benefit. We may make a change without observing the 30-day period only where a legal or regulatory obligation requires us to act in a way that does not allow us to respect it, or where an immediate change is necessary to address an unforeseen and imminent danger, including one arising from fraud, malware, spam, a data breach or another cybersecurity risk.

2. Eligibility

To use OnFire, you must:

  • Be at least 13 years of age (or the minimum age required in your jurisdiction)
  • Users under 18 must have parental or guardian consent
  • Not be a convicted sex offender
  • Not have been previously banned from our Service
  • Provide accurate, current, and complete registration information

For certain features (payments, marketplace, accommodations), you must be at least 18 years old or the age of majority in your jurisdiction.

3. Account Registration and Security

3.1 Account Creation

To access most features, you must create an account by providing a valid phone number or email address, your name (display name), and profile information as requested. You agree to provide accurate information and keep it updated. You may only create one account for personal use.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Not sharing your account or transferring it without our permission

4. Services Provided

OnFire provides an integrated platform combining multiple services:

Social Networking

Profile creation and management, news feed and content discovery, posts, photos, videos, and stories, groups and community features, following and friend connections.

Messaging and Communication

Private messaging, group chats and channels, voice and video calls, end-to-end encrypted conversations (where enabled), media sharing, message reactions and replies.

Location Services

Real-time location sharing with selected contacts, location history and check-ins, safety features and alerts, geofencing notifications.

Marketplace and E-Commerce

Buying and selling products, product listings and discovery, secure payment processing, seller verification and ratings, order tracking.

Accommodations and Rentals

Property listings for short-term rentals, booking and reservation management, host and guest profiles, reviews and ratings.

Wallet and Productivity

Digital wallet functionality, peer-to-peer payments, cryptocurrency support (where available), task management, habit tracking, calendar integration.

5. User Conduct and Prohibited Activities

5.1 General Conduct

You agree to use OnFire responsibly and lawfully. You must not:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Harass, bully, threaten, or intimidate others
  • Post false, misleading, or defamatory content
  • Engage in fraud, scams, or deceptive practices
  • Spam or send unsolicited communications

5.2 Prohibited Content

You must not post, share, or transmit:

  • Illegal content or content promoting illegal activities
  • Child sexual abuse material (CSAM) or exploitation (see Section 15 for our scanning and reporting obligations)
  • Non-consensual intimate imagery
  • Content promoting violence, terrorism, or hate
  • Malware, viruses, or harmful code
  • Content that violates others' privacy

5.3 Platform Integrity

You must not attempt to access accounts or data without authorization, circumvent security measures, use automated tools or bots without permission, reverse engineer our software, interfere with the Service's operation, or create fake accounts.

5.4 Zero-Tolerance Policy and Enforcement

OnFire has zero tolerance for objectionable content and abusive users. Objectionable content includes, without limitation, content that is defamatory, obscene, pornographic, harassing, threatening, hateful, or that depicts or promotes violence, self-harm, illegal activity, or the exploitation of minors.

By using OnFire you agree not to post objectionable content or to harass, bully, or abuse other users. We provide tools to report objectionable content and to block abusive users. Reporting controls are currently available on feed posts, rental and vehicle listings and their owners, and food orders. They are not yet available on stories, profiles, live streams, communities or comments, and reporting an individual chat message is not yet functional. We are extending reporting to those surfaces. In the meantime you can report anything to us at [email protected].

We may filter, remove, or restrict any content, and may suspend or permanently terminate the account of any user who posts objectionable content or behaves abusively. Where the urgency of a safety risk requires it, we may act before we notify you. We will then tell you what we have done, the reasons for it, and how to challenge the decision, unless a legal obligation prevents us from doing so.

We review reports of objectionable content and abusive users and act on them, including removing offending content and removing offending users. Reports are triaged by severity, with reports involving child safety treated as the highest priority. We are not currently able to commit to a fixed response time, and we will not state one until it is a time we can keep. To report content or a user, use the in-app report control where it is available — currently on feed posts, listings, products, rides and car rentals — or contact us at [email protected]. You can block another user from their profile.

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of content you create and share on OnFire ("User Content"). By posting content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, display, distribute, and make your content available to others, modify content for technical purposes, and use content for promotional purposes (with your settings). This license continues until you delete your content or account.

6.2 Content Responsibility

You are solely responsible for your User Content and represent that you own or have rights to share the content, it does not violate these Terms or any laws, and it does not infringe on third-party rights.

6.3 Our Intellectual Property

OnFire, including its design, features, code, and branding, is owned by us and protected by intellectual property laws. You may not use our trademarks, logos, or branding without written permission.

6.4 Copyright and DMCA

We respect intellectual property rights. If you believe content infringes your copyright, submit a notice to our designated agent with identification of the copyrighted work, location of the infringing content, your contact information, a statement of good faith belief, a statement of accuracy under penalty of perjury, and your signature.

7. Privacy and Data

Your privacy is important to us. Our Privacy Policy, incorporated into these Terms, explains how we collect, use, and protect your information. By using OnFire, you consent to our data practices as described in the Privacy Policy.

8. Payments and Transactions

Payment Processing

We use third-party payment processors for transactions. By making payments, you agree to their terms and authorize us to charge your selected payment method.

Fees and Pricing

Service fees may apply to certain transactions. All fees are displayed before confirmation. Prices are in the currency specified at checkout. Taxes may apply based on your location.

Refunds and Disputes

Refund policies vary by transaction type. Marketplace disputes are handled through our resolution center. Accommodation cancellation policies are set by hosts. We are not responsible for disputes between users.

Subscriptions

Subscriptions auto-renew unless cancelled. Cancel anytime through account settings. No refunds for partial billing periods. Price changes will be communicated in advance.

9. Third-Party Services and Links

OnFire may integrate with or link to third-party services. We are not responsible for third-party content, products, or services; privacy practices of third parties; availability or accuracy of external links; or transactions with third parties. Your use of third-party services is at your own risk and subject to their terms.

10. Disclaimers and Limitations

10.1 Service Availability

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation, specific features or functionality, data preservation beyond our stated policies, or compatibility with all devices or systems.

10.2 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for indirect, incidental, special, or consequential damages
  • Our total liability is limited to amounts you paid us in the past 12 months, or $100, whichever is greater
  • We are not liable for actions of other users or loss of data, profits, or business opportunities

These limitations do not apply to liability that cannot be excluded by law.

10.4 User Interactions

You are solely responsible for your interactions with other users. We do not verify user identities or conduct background checks (except as required for specific features). Exercise caution when meeting others or sharing personal information.

11. Indemnification

You agree to indemnify and hold harmless OnFire, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your User Content, your violation of these Terms, your violation of any third-party rights, and your transactions with other users.

12. Account Termination

12.1 Termination by You

You may delete your account at any time through account settings. Upon deletion, your profile and content will be removed, some information may be retained as required by law, deletion may take up to 90 days to complete, and certain data may persist in backups temporarily.

12.2 Termination by Us

We may suspend or terminate your account if you violate these Terms or our policies, engage in illegal or harmful activities, create risk or legal exposure for us, or have an account inactive for extended periods. We will tell you what we have decided and why, no later than the date the restriction takes effect, unless a legal obligation prevents us from doing so. We will tell you: what we did, where it applies and for how long; the facts we relied on and whether we learned of the matter from a report or from our own detection; whether automated means were used; the legal ground or the specific term of these Terms we relied on; and how to challenge the decision.

12.3 Effect of Termination

Upon termination, your right to use the Service ends immediately, provisions that should survive will remain in effect, and we may retain certain information as required by law.

13. Dispute Resolution

Talking to us first

If something goes wrong, please contact us at [email protected] so we can try to resolve it directly. Most disputes are settled faster that way. This is a request, not a condition — nothing here stops you going to court, or to any dispute-resolution body available to you, at any time.

Which company you are contracting with

Your counterparty is OnFire Messenger Inc., a Delaware corporation. Its registration details and address are set out in Who We Are and How to Contact Us.

Governing law and courts

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles, and you and OnFire Messenger Inc. submit to the jurisdiction of the state and federal courts located in Delaware.

Arbitration

If you are resident in the United States, disputes will be resolved by binding arbitration rather than in court, except that either of us may bring a claim in small-claims court.

Nothing here limits your statutory rights

Nothing in this section removes a right you have under the law of the country where you live that cannot be removed by agreement. Where any part of this section conflicts with such a right, that right prevails and the rest of this section continues to apply.

14. General Provisions

Entire Agreement: These Terms, along with our Privacy Policy and other referenced policies, constitute the entire agreement between you and OnFire.
Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
No Waiver: Our failure to enforce any provision does not waive our right to do so later.
Assignment: You may not assign these Terms without our consent. We may assign our rights freely.
Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control.

15. Child Safety Scanning & Content Monitoring

OnFire is committed to protecting minors on our platform. To fulfill our legal obligations under 18 U.S.C. § 2258A and other child protection laws, we employ automated safety systems to detect child sexual abuse material (CSAM) and grooming behavior. By using OnFire, you acknowledge and consent to the operation of these systems.

15.1 On-Device Safety Scanning

OnFire uses on-device artificial intelligence models to analyze text-based conversations for patterns indicative of grooming or exploitation of minors. This scanning occurs locally on your device and does not transmit message contents to our servers unless a safety threshold is exceeded. On supported iOS devices (iOS 17+), Apple's Sensitive Content Analysis framework may additionally scan media for known CSAM material.

15.2 Server-Side Safety Systems

When on-device scanning identifies content that exceeds our safety thresholds, limited metadata and safety event data may be sent to our servers for further analysis. Server-side systems include cloud-based confirmation of flagged content, perceptual hash matching against known CSAM databases, and human review by trained moderators for escalated cases.

15.3 Graduated Enforcement

Based on risk severity, OnFire may take the following graduated enforcement actions:

Low Risk: Safety event logged for monitoring; no immediate user impact
Medium Risk: Content flagged for human review; server-side confirmation initiated
High Risk: Age re-verification may be required; conversation restrictions applied
Critical Risk: Conversation locked; mandatory report filed with NCMEC; account may be suspended pending review

15.4 NCMEC Reporting

As a registered Electronic Service Provider (ESP ID: 6934), OnFire is legally required to report apparent violations involving CSAM to the National Center for Missing & Exploited Children (NCMEC) CyberTipline as soon as reasonably possible, as required by 18 U.S.C. ยง 2258A. Reports include relevant metadata, safety event details, and any content necessary to fulfill our legal obligations. We may not notify the user of such reports as required by law.

15.5 Conversation Restrictions

When our safety systems detect critical-level risks, conversations may be temporarily locked to prevent further harm. Locked conversations remain accessible for reading but new messages cannot be sent. Where we lock a conversation, we will tell both participants that the conversation has been restricted, that an automated system made that decision, and the general reason for it. We will also tell you how to challenge it: you may ask us to review the lock by writing to [email protected], you may complain to your data protection supervisory authority, and you may seek a remedy from a court. Restrictions are subject to human review and may be lifted if determined to be false positives.

15.6 Your Obligations

You agree not to attempt to circumvent, disable, or interfere with safety scanning features. Attempting to bypass safety systems constitutes a violation of these Terms and may result in immediate account termination. You acknowledge that safety scanning is essential to our legal compliance and the protection of minors on our platform.

16. Special Terms for Specific Features

Location Sharing

Location sharing is optional and controlled by you. You can enable/disable sharing at any time. Shared locations are visible only to those you authorize.

Accommodations

Hosts are responsible for compliance with local laws. Guests must follow house rules. We are not responsible for property conditions or host conduct. Cancellation policies are set by hosts.

Cryptocurrency Features

Cryptocurrency values fluctuate; we are not responsible for losses. You are responsible for securing your wallet credentials. Features may not be available in all jurisdictions.

End-to-End Encrypted Messages

E2E encrypted messages are only readable by participants. We cannot recover encrypted messages if you lose access. Certain features may not be available in encrypted chats.

17. Content Moderation: What We Restrict, and How We Decide

17.1 What we restrict

We restrict content that is illegal under applicable law, and content that breaks the rules set out in Section 5 of these Terms. "Restrict" means any of: removing content or hiding it from others; limiting how widely it is shown; locking a conversation; limiting access to features; suspending or terminating an account; or suspending payments connected to an account.

17.2 How we find out

Three ways: someone reports it using the Report control in the app or by writing to [email protected]; an authority orders us to act; or our own systems detect it.

17.3 Automated tools

We use automated systems in two ways, and they work differently.

Where you report something to us, automated tools only sort the queue — the priority a report receives comes from the category you choose when you submit it. A person reviews the report and decides what to do. Nothing happens to the reported content or account automatically.

Where our child-safety systems detect a critical risk in a conversation, that conversation may be locked automatically, without a person reviewing it first, for both participants. We do this to stop immediate harm. A person reviews the lock afterwards, and you can ask us to review it by writing to [email protected]. These systems analyse text; they do not classify images or video.

17.4 Human review

Decisions to restrict content or an account are taken by trained staff, with one exception: our automated safety system can lock a conversation without a person having reviewed it first. That lock applies to both participants, including someone who may have done nothing wrong. If it happens to you, you can ask us to have a person reconsider it, and we will.

17.5 What we tell you

What we tell you depends on the measure. If we freeze your account, we tell you why and open an appeal you can use. If we suspend an accommodation listing, we notify the host. Other measures — removing a post, comment or story, rejecting an advert, or reducing how widely something is shown — do not currently generate a notice, so if something of yours is no longer visible you may not have been told. We are building this out; until then, you can ask us at [email protected] and we will tell you what happened and why. The information we give on a freeze is set out in Section 12.2.

17.6 Challenging a decision

If we freeze your account, we tell you why and you may appeal once, by the deadline shown on the frozen-account screen. If a decision concerns your business category or a restriction on your business, you may appeal to [email protected] with supporting documentation, and we review it within 10 business days.

17.7 Ranking and recommendations

We do not personalise your feeds. Your main feed, the video feed and Stories show posts newest first, the same order for everyone. Search matches your words and shows matches newest first. Listing pages show a small number of listings selected by our staff, then the newest, with closer listings first where you have shared your location. Accommodation search is ranked on eight factors, the largest being how well the listing matches your search words and whether it is free on your dates. Nobody can pay to rank higher anywhere on OnFire. The full explanation is at How OnFire Decides What You See.

17.8 How we enforce

When we enforce these Terms we aim to act proportionately, to take account of context, and to weigh the interests of everyone affected, including the right to freedom of expression.

18. Our Policy on Terrorist Content

18.1 Terrorist content is prohibited

Terrorist content is not allowed on OnFire. This includes material that incites, solicits or contributes to terrorist offences, that solicits a person or group to participate in the activities of a terrorist group, that glorifies terrorist activity, or that provides instruction in the making or use of explosives, firearms or other weapons for the purpose of committing a terrorist offence. This sits alongside the prohibition on content promoting violence, terrorism or hate in Section 5.2.

18.2 How we address it

We act on terrorist content in two ways:

  • Reports. Anyone can report content using the report control where it is available, or by writing to [email protected]. Reports are reviewed by a person, who decides what action to take.
  • Our own review. Where we become aware of terrorist content ourselves, we remove it and may restrict or terminate the account responsible under Section 12.

18.3 Automated tools

Our automated tools are not currently configured to detect terrorist content. The automated systems we run are described in Section 17.3 and are directed at child sexual abuse material and grooming.

This does not mean such material always passes unnoticed. Terrorist content is frequently also hateful or violent, and our general content classification does cover hate and violence — so material of this kind may well be caught, but it would be caught and recorded as hate or violence rather than as terrorism.

By using OnFire, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
