1. Introduction and Acceptance

These Car Rental Terms (this "Renter Agreement") govern your rental of a motor vehicle listed by another user (the "Owner") through the OnFire platform. OnFire operates a peer-to-peer marketplace that connects renters with vehicle owners; OnFire is not the owner, lessor, or supplier of any vehicle and is not a party to the rental itself.

By confirming a booking you accept the version of this Renter Agreement presented to you at checkout. The specific version you accept is recorded against your booking for audit purposes. These terms are in addition to the OnFire Terms of Service and Privacy Policy.

2. Eligibility, Age & Driving Licence

To book and drive a vehicle you must:

  • Meet the minimum driver age set by the Owner for the listing (typically 21; some listings set a higher age).
  • Hold a full, valid driving licence that is current for the entire rental period and valid in the jurisdiction where the vehicle is used.
  • Provide accurate licence details and, where requested, a photograph of your licence for verification.
  • Be the sole authorised driver unless additional drivers are approved by the Owner. Only approved drivers may operate the vehicle.

You are responsible for confirming that your licence permits you to drive the class of vehicle booked. Providing false eligibility or licence information voids the rental and may result in loss of deposit and account action.

3. Security Deposit & Pre-Authorization

Most listings require a refundable security deposit. The deposit amount is shown before you book and is frozen against your booking at the time of booking.

You authorize OnFire and its payment processor to place a pre-authorization hold on your payment method for the deposit amount at the start of your trip. A hold reserves funds; it is not a charge. Provided the vehicle is returned on time and without damage, mileage overage, fuel/charge shortfall, fines, or other chargeable items, the hold is released after the trip ends.

Where an Owner opens a valid claim, part or all of the deposit may be captured to settle the claim, subject to the dispute process. Full details of hold timing, release, capture, and adjudication are set out in the Car Deposit Policy.

4. Mileage Limits & Overage Charges

Listings may include a daily mileage allowance or offer unlimited mileage. Where a per-day allowance applies, your total included mileage is the daily allowance multiplied by the number of billed days, frozen against your booking.

If you exceed the included mileage, an overage fee applies for each kilometre over the allowance, at the per-kilometre rate shown for the listing at booking. Overage is calculated from the odometer readings recorded at handover and return and may be settled from your security deposit.

5. Fuel & Charging Policy

Each listing specifies a fuel or charging policy, which is one of:

Full-to-full

Return the vehicle with the same fuel/charge level as at handover. Shortfalls are billable at the listing's refuel/recharge rate.

Same-to-same

Return at the same level as received; the level at handover is recorded for both parties.

Prepaid

You prepay for fuel/charge and may return at any level without a refuel charge.

Free

No fuel/charge obligation applies for this listing.

Where the policy bills a shortfall, the amount may be settled from your security deposit.

6. Vehicle Condition & Photo Consent

At the start and end of each trip, you and the Owner may record the vehicle's condition, including timestamped photographs and the odometer reading. You consent to the capture, storage, and use of these condition photographs as evidence of the vehicle's state at handover and return.

Condition photographs and readings are used to resolve disputes about damage, mileage, and fuel/charge, and are retained for the periods described in the Car Rental Privacy Addendum. You must not obscure, alter, or refuse reasonable condition documentation.

7. Insurance & Liability (No Coverage)

OnFire does not provide any insurance, damage waiver, protection product, or liability coverage for peer-to-peer car rentals.

Any protection tier or fee that may appear in the app is a placeholder and does not represent an active insurance policy unless and until expressly stated otherwise. You must not rely on OnFire for any coverage.

You are solely responsible for ensuring the vehicle is legally insured for your use for the entire rental period, whether through the Owner's policy (where it extends to you), your own policy, or a third-party rental insurance product. You are responsible for confirming coverage before driving.

You are liable for damage to the vehicle, injury to persons, damage to third-party property, theft, fines, tolls, and penalties arising during your rental, to the maximum extent permitted by law. OnFire is not liable for any such loss.

8. Prohibited Use

You must not, and must not permit any driver to:

  • Drive under the influence of alcohol, drugs, or any impairing substance.
  • Use the vehicle for any illegal purpose, race, speed test, or off-road use not permitted by the Owner.
  • Sublet, re-rent, or use the vehicle for hire, ride-hail, or delivery without the Owner's written consent.
  • Allow an unapproved or unlicensed person to drive.
  • Transport hazardous materials, tow beyond the vehicle's rating, or carry more passengers than seatbelts.
  • Take the vehicle outside any geographic area specified by the Owner or applicable law.
  • Smoke in the vehicle where prohibited, or return it in a condition requiring special cleaning.

Prohibited use voids any protection that might otherwise apply, exposes you to full liability, and may result in loss of deposit and account termination.

9. Cancellations & No-Shows

Refunds on cancellation depend on the Owner's cancellation tier (flexible, moderate, or strict) and how far in advance you cancel. Failure to collect the vehicle is a no-show and is non-refundable. If the Owner fails to hand over the vehicle, you are entitled to a full refund. See the Car Cancellation Policy for the exact refund tiers.

10. Data & Privacy

To operate a rental we process personal data including your driving licence details and image, date of birth (for age and payment verification), and vehicle condition photographs. How we use, share, and retain this data is described in the Car Rental Privacy Addendum, which supplements the main Privacy Policy.

By confirming a car rental booking, you acknowledge that you have read and agree to this Renter Agreement in the version presented at checkout.
