Who You Are Contracting With
OnFire is operated by two companies. Which one you contract with depends on where you are located.

This document is the version that applies where your counterparty is OnFire Messenger Ltd. If your counterparty is OnFire Messenger Inc., the corresponding United States version applies to you instead, and is available in the OnFire Legal Center at https://onfire.so/legal.

Data protection. Where this document concerns personal data, the company named above as your counterparty is the data controller for your personal data. For users in the European Economic Area that is OnFire Messenger Ltd., and the supervisory authority is the Irish Data Protection Commission. For users in the United States that is OnFire Messenger Inc., and the rights set out in the United States Privacy Policy apply instead.
If you move, or deal across regions. The company you contract with is determined by where you are located when you use the Services. If you relocate permanently to the other region, the version applying to that region will govern your use of the Services from that point. Dealing with a user, merchant, courier, driver or host located in the other region — for example, buying from a seller in the United States while you are in the European Economic Area — does not change which company you contract with, and does not affect any mandatory consumer protection you have under the law of your country of residence.
1. Definitions
1.1. "OnFire", "we", "us", or "our" means OnFire Messenger Ltd., a company registered in Ireland with company number 796932, whose registered office is at 77 Camden Street Lower, Dublin, D02 XE80, Ireland.
1.2. "OnFire Platform" means the OnFire mobile application ("OnFire App") and associated website at https://onfire.so, including all features, tools, and services made available through them.
1.3. "Courier", "Delivery Partner", "you", or "your" means any natural person who registers on the OnFire Platform and enters into these Terms for the purpose of providing Delivery Services.
1.4. "Delivery Services" means the collection of an Order from a Merchant Partner and its transportation and delivery to a Customer at the specified delivery address.
1.5. "Customer" means any natural person who places an Order through the OnFire Platform.
1.6. "Merchant Partner" or "Merchant" means any restaurant, cafe, food establishment, or other business that has entered into a separate agreement with OnFire to offer its products for sale through the OnFire Platform.
1.7. "Order" means a request placed by a Customer through the OnFire Platform to purchase items from a Merchant Partner and have them delivered.
1.8. "Courier Fee" means the fee payable to the Courier by OnFire for each completed delivery, calculated in accordance with clause 5.
1.9. "In-App Payment" means payment processed through the OnFire Platform.
1.10. "Courier Account" means the account created by the Courier on the OnFire Platform for the purpose of receiving and fulfilling delivery requests.
1.11. "Delivery Area" means the geographic area within which the Courier elects to make themselves available for Delivery Services.
2. Nature of the Relationship
2.1. The Courier is an independent contractor. Nothing in these Terms creates, implies, or constitutes an employment relationship, partnership, joint venture, agency, or franchise between the Courier and OnFire.
2.2. The Courier is not an employee, worker, agent, or representative of OnFire. The Courier is not entitled to any employment benefits, including but not limited to holiday pay, sick pay, pension contributions, or employment insurance, except as may be required by mandatory applicable law.
2.3. OnFire provides an information society service and technology platform that facilitates connections between Customers, Merchant Partners, and Couriers. OnFire does not provide delivery services directly.
2.4. The Courier retains full discretion to:
(a) determine when, where, and for how long to make themselves available on the OnFire Platform;
(b) accept or decline any delivery request at their sole discretion without penalty, subject to clause 7;
(c) provide delivery services to third-party platforms or engage in other commercial activities simultaneously; and
(d) engage substitutes or assistants to perform Delivery Services, provided such persons meet the eligibility requirements in clause 3 and are registered with OnFire.
2.5. OnFire does not direct the means or methods by which the Courier performs Delivery Services. The Courier is free to determine the route, mode of transport, and manner of delivery, subject to applicable law and food safety requirements.
3. Registration and Eligibility
Personal Requirements
3.1. To register as a Courier on the OnFire Platform, you must:
(a) be at least eighteen (18) years of age;
(b) have the legal right to work in the jurisdiction in which you wish to provide Delivery Services;
(c) provide a valid government-issued photo identification document;
(d) provide accurate and complete personal information, including your full legal name, address, date of birth, and contact details;
(e) consent to a background check, which may include verification of identity, criminal record, and right to work status; and
(f) not have been previously suspended or terminated from the OnFire Platform for cause.
3.2. OnFire reserves the right to refuse any application for registration at its sole discretion.
Vehicle and Equipment Requirements
3.3. If you provide Delivery Services using a vehicle (including a bicycle, e-bike, scooter, motorcycle, or car), you must:
(a) hold all licences, permits, and certifications required by applicable law for the operation of that vehicle;
(b) maintain the vehicle in a safe and roadworthy condition at all times;
(c) comply with all applicable traffic laws and regulations; and
(d) maintain valid insurance covering the use of the vehicle for commercial delivery purposes, where required by law.
3.4. You must maintain and use an insulated delivery bag or container of sufficient size and quality to ensure the safe and hygienic transportation of food items at appropriate temperatures.
3.5. You must have a compatible smartphone or mobile device capable of running the OnFire App and maintaining a data connection throughout each delivery.
Ongoing Obligations
3.6. You must promptly update your registration information if any details change, including your address, vehicle type, insurance, or right to work status.
3.7. OnFire may periodically require you to re-verify your eligibility, update documentation, or undergo additional background checks.
4. Providing Delivery Services
Accepting and Performing Deliveries
4.1. When you are online and available on the OnFire Platform, you may receive delivery requests. Each request will include the Merchant Partner's location, the estimated delivery address, the estimated Courier Fee, and the estimated distance.
4.2. You may accept or decline any delivery request at your sole discretion. Acceptance of a delivery request creates an obligation to complete that delivery in accordance with these Terms.
4.3. Upon accepting a delivery request, you shall:
(a) proceed promptly to the Merchant Partner's premises to collect the Order;
(b) verify the Order contents against the Order summary displayed in the OnFire App (to the extent reasonably practicable without opening sealed packaging);
(c) transport the Order safely and hygienically, maintaining appropriate temperatures using an insulated delivery bag;
(d) deliver the Order to the Customer at the specified delivery address within a reasonable timeframe;
(e) follow any delivery instructions provided by the Customer (e.g., contactless delivery), where reasonably practicable; and
(f) confirm delivery completion through the OnFire App.
Professional Conduct
4.4. While providing Delivery Services, you shall:
(a) act professionally, courteously, and respectfully towards Customers, Merchant Partners, and OnFire staff;
(b) comply with all applicable laws and regulations, including traffic laws, food safety regulations, and data protection legislation;
(c) not consume, tamper with, or open any part of an Order;
(d) not operate a vehicle under the influence of alcohol, drugs, or any substance that impairs your ability to deliver safely;
(e) maintain personal hygiene and a clean, presentable appearance; and
(f) not engage in any discriminatory, abusive, threatening, or harassing behaviour.
Communication
4.5. You must keep your phone available and responsive during an active delivery. You may need to communicate with the Customer or OnFire support regarding the delivery. All communication with Customers should be conducted through the OnFire App where possible.
5. Fees and Payment
Courier Fee
5.1. For each completed delivery, OnFire will pay you a Courier Fee. The Courier Fee is calculated based on factors that may include:
(a) a base fee per delivery;
(b) distance from the Merchant Partner to the Customer's delivery address;
(c) estimated time for the delivery; and
(d) prevailing demand and Courier availability in the area.
5.2. The estimated Courier Fee will be displayed in the OnFire App at the time you receive a delivery request. The final Courier Fee may be adjusted based on the actual distance and route taken.
Surge and Peak Pricing
5.3. During periods of high demand or limited Courier availability, increased Courier Fees may apply ("Surge Pricing"). Surge Pricing is determined dynamically by the OnFire Platform and will be displayed at the time of the delivery request.
Tips
5.4. Customers may leave voluntary tips for Couriers through the OnFire App. 100% of all tips are passed to the Courier. Tips are in addition to the Courier Fee and are not subject to any commission or deduction by OnFire.
Payment Schedule
5.5. Courier Fees and tips are accumulated and paid to you on a weekly basis. Payments will be made by electronic transfer to the bank account you have registered on the OnFire Platform.
5.6. OnFire will provide you with a statement of earnings for each payment period, accessible through the OnFire App.
Tax Obligations
5.7. As an independent contractor, you are solely responsible for all tax obligations arising from your provision of Delivery Services, including but not limited to income tax, Universal Social Charge (USC), Pay Related Social Insurance (PRSI) where applicable, and value-added tax (VAT) if you exceed the applicable registration threshold.
5.8. OnFire does not withhold taxes on your behalf. You are responsible for registering with the Revenue Commissioners (or the equivalent tax authority in your jurisdiction) and for filing all required tax returns.
5.9. You may be required to provide OnFire with a valid tax identification number or other tax-related documentation.
Invoicing
5.10. OnFire may issue invoices or self-billing invoices on your behalf for the Courier Fees paid to you, in accordance with applicable tax regulations. You hereby authorise OnFire to issue self-billing invoices where permitted by law.
6. OnFire Service Fee
6.1. OnFire charges a service fee ("Platform Fee") for the use of the OnFire Platform. The Platform Fee is a percentage of the Courier Fee, as specified in your registration agreement or as updated from time to time with reasonable notice.
6.2. The Platform Fee is deducted from the Courier Fee before payment is made to you. The applicable Platform Fee and deduction will be transparently displayed in your earnings statement.
6.3. OnFire may update the Platform Fee from time to time. Any changes will be communicated to you on a durable medium with at least fifteen (15) days' notice, or longer where you need that time to make technical or commercial adaptations. Your continued use of the OnFire Platform after the effective date of a fee change constitutes acceptance of the updated fee.
6.4. Late payment of any amounts owed by you to OnFire may incur interest at the rate of 2% per annum above the European Central Bank's main refinancing rate, calculated daily from the due date until the date of actual payment.
7. Ratings and Performance
Ratings
7.1. Customers may rate their delivery experience after each Order. Your average rating will be displayed in your Courier Account.
7.2. Ratings are based on factors including delivery timeliness, professionalism, and Order condition upon delivery.
Performance Metrics
7.3. OnFire may monitor the following performance metrics:
(a) Acceptance Rate: The percentage of delivery requests you accept out of total requests received while online.
(b) Completion Rate: The percentage of accepted deliveries that you successfully complete.
(c) Average Rating: Your average customer rating over a rolling period.
(d) Delivery Time: Your average delivery time compared to estimated delivery times.
7.4. OnFire may establish minimum performance thresholds for each metric. These thresholds will be communicated to you through the OnFire App.
Consequences of Low Performance
7.5. If your performance falls below the established thresholds, OnFire may, at its discretion:
(a) issue a warning notification with guidance on improvement;
(b) temporarily restrict access to delivery requests during peak periods;
(c) temporarily suspend your Courier Account for a specified period; or
(d) in cases of persistently low performance, terminate your access to the OnFire Platform in accordance with clause 10.
7.6. Performance assessments are conducted fairly and take into account factors outside your control, such as traffic conditions, Merchant preparation delays, and extreme weather.
8. Insurance and Liability
Courier's Insurance Obligations
8.1. You are solely responsible for obtaining and maintaining all insurance required by applicable law for the provision of Delivery Services, which may include:
(a) motor vehicle insurance covering commercial use (if using a motorised vehicle);
(b) public liability insurance; and
(c) personal accident insurance.
8.2. You must ensure that your insurance coverage is valid and adequate throughout the period in which you provide Delivery Services. OnFire may request proof of insurance at any time.
Liability
8.3. You are solely liable for any loss, damage, or injury arising from your provision of Delivery Services, including but not limited to:
(a) damage to an Order during collection, transportation, or delivery;
(b) personal injury or property damage caused by your acts or omissions;
(c) traffic violations, fines, or penalties incurred during Delivery Services; and
(d) any claim brought by a Customer, Merchant Partner, or third party in connection with your Delivery Services.
8.4. OnFire is not liable for any injury, loss, or damage sustained by you during the provision of Delivery Services, except to the extent caused by OnFire's gross negligence or wilful misconduct.
8.5. You agree to indemnify and hold harmless OnFire, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising from your provision of Delivery Services or your breach of these Terms.
9. Data Protection
9.1. OnFire processes your personal data in accordance with our Courier Privacy Policy, available at https://onfire.so/legal/privacy-policy-couriers.
9.2. In the course of providing Delivery Services, you may have access to personal data of Customers (such as names, delivery addresses, and phone numbers). You must:
(a) use such data solely for the purpose of completing the relevant delivery;
(b) not retain, copy, or store Customer data beyond the completion of the delivery;
(c) not disclose Customer data to any third party; and
(d) comply with all applicable data protection legislation, including the GDPR.
9.3. Any breach of data protection obligations may result in immediate suspension or termination of your Courier Account and may be reported to the Data Protection Commission.
10. Suspension and Termination
Termination by the Courier
10.1. You may terminate your agreement with OnFire and close your Courier Account at any time by providing at least seven (7) days' written notice to OnFire at [email protected].
10.2. Upon termination, any outstanding Courier Fees and tips owed to you will be paid in accordance with the normal payment schedule.
Termination by OnFire
10.3. OnFire may terminate your access to the OnFire Platform by providing at least three (3) days' written notice to you.
10.4. OnFire may suspend or terminate your Courier Account immediately and without notice in the event of:
(a) a serious breach of these Terms, including but not limited to fraud, theft, violence, harassment, or criminal conduct;
(b) conduct that poses a risk to the safety of Customers, Merchant Partners, or the public;
(c) providing false or misleading information during registration or at any time thereafter;
(d) operating under the influence of alcohol or drugs while providing Delivery Services;
(e) tampering with or consuming any part of an Order;
(f) persistent failure to meet minimum performance thresholds after receiving warnings; or
(g) any violation of applicable law in connection with the Delivery Services.
Suspension
10.5. OnFire may temporarily suspend your Courier Account pending investigation of any complaint or alleged breach. During suspension, you will not be able to accept delivery requests.
10.6. OnFire will use reasonable efforts to notify you of the reasons for suspension and provide an opportunity to respond, except where doing so would compromise an ongoing investigation or pose a safety risk.
EU Platform-to-Business Regulation Compliance
10.7. In accordance with Regulation (EU) 2019/1150 on promoting fairness and transparency for business users of online intermediation services ("P2B Regulation"), OnFire will:
(a) provide a clear statement of reasons for any restriction, suspension, or termination of your Courier Account;
(b) maintain an accessible internal complaints-handling route for disputes related to the Delivery Services, as described in clause 10.8.
10.8. The internal complaints-handling route is by email to [email protected], with supporting documentation. We will deal with your complaint as promptly as we can. We do not state a response time here, because we are not currently able to commit to one we would meet.
11. Governing Law and Dispute Resolution
11.1. These Terms shall be governed by and construed in accordance with the laws of Ireland.
11.2. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.
11.3. Without prejudice to your right to bring proceedings before the courts, you may also seek to resolve disputes through mediation in accordance with the Mediation Act 2017 (Ireland).
11.4. If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect.
11.5. The failure of OnFire to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
11.6. These Terms constitute the entire agreement between you and OnFire with respect to your provision of Delivery Services through the OnFire Platform.
